Brief Description of Case:

6th Grade plaintiff allegedly slipped and fell on defective condition in boy’s bathroom and lacerated the back of his leg on alleged defective condition on bathroom stall.  Allegations were uneven surface, liquid on the floor and sharp edge of stall.  Negligent supervision claims were dismissed via motion for summary judgment.

Court or Jury’s Decision and Reasoning:

Jury unanimously found that the plaintiffs failed to prove negligence with respect to the existence of a defective condition being the proximate cause of the accident.
