Brief Description of Case:

Plaintiff alleged that while in hallway, after lunch, he was pushed into door and suffered a laceration. Plaintiff alleged failure to provide supervision and improper supervision.

Court or Jury’s Decision and Reasoning:

Incident occurred April 2013.  After multiple motions to compel, discovery and court orders, we served yet another motion, this time asking the court to dismiss for willful and contumacious behavior.  The second part of the motion was for summary judgment. We provided video of hallway showing multiple adults supervising; affidavit from Principal regarding staff assigned to supervise, etc. Plaintiff did not oppose. Court granted first part of motion, did not need to address second argument.
