Plaintiff, Antonietta Zappier was a DJ at a school dance. Claims she slipped and fell on an ice cube that was on the floor after students had an ice fight.

Motion or summary judgment granted prior to depositions. At her 50-h, Antonietta Zappier testified the students had an ice fight. The video, a full one and one half hours before her fall shows there was no ice fight.  Summary judgment motion made citing to the video and affidavit from Principal that they do not allow ice at school dances. Plaintiff filed a Stipulation of Discontinuance upon receipt of motion.
