Brief Description of Case:

Infant plaintiff went on weekend trip to Greenkill facility. Was on top bunk of bunk beds, got up to use the bathroom. Plaintiff either missed the ladder rung or the ladder entirely, fell and was injured.

Court or Jury’s Decision and Reasoning:

Court granted summary judgment to District and codefendant holding that there is no evidence there was anything defective with the ladder, that the supervision was proper, and that the incident occurred in such a short period of time no amount of supervision could have prevented it.
