Mr. Donlon is an experienced senior trial lawyer, whose career has spanned more than four decades, and has taken him to all State and Federal trial courts in the New York metropolitan area. While with Consolidated Edison, Mr. Donlon not only defended the company's interests in personal injury and property damage lawsuits, he also represented the company in some of the most significant utility affairs litigation then before the courts, including matters involving the payment for utility services provided to welfare recipients, Rivera v. Berger , 89 Misc.2d 5586, 390 N.Y.S.2d 537 (N.Y. Sup. Ct. 1976), aff'd 60 A.D.2d 605, 399 N.Y.S.2d 102 (2 nd Dept. 1977), app. dism. , 43 N.Y.2d 949, 403 N.Y.S.2d 1030 (N.Y.), mot. lv. app. denied , 44 N.y.3d 642, 405 N.Y.S.2d 1026 (1978).
He was the trial counsel on a leading case involving state pre-emption in matters involving the siting of power plants, Consolidated Edison v. Town of Red Hook , 60 N.Y.2d 99, 468 N.Y.S.2d 596 (N.Y. 1983) and was responsible for the papers which defeated the plaintiffs' application for class certification following the 1977 New York City blackout. Vincent Petrosino Seafood Corp. v. Consolidated Edison , 97 Misc.2d 110, 410 N.Y.S.2d 746 (N.Y. Sup. Ct. 1978). Additionally, the motion papers he prepared in Mid-Hudson Nuclear Opponents v. Consolidated Edison , 100 Misc.2d 158, 418 N.Y.S.2d 883 (N.Y. Sup. Ct. 1979) were chosen for publications in 9 Bender's Forms For Civil Practice, Forms No. 3212:63, 3212:64, 3212:65.
While at CFO, Mr. Donlon has focused his practice on complex litigation, handling matters including gas explosions, electric files, commercial and residential premises liability, interstate trucking, products liability, municipal liability, construction accidents, and mechanics liens. He has appeared before the appellate benches of the First and Second Departments of the New York State Appellate Division of the New York Supreme Court and has participated in mock trials, lectured to bar associations and participated in NITA programs as a faculty member.
Mr. Donlon is a member of the New York State Trial Lawyers Association. He received his Juris Doctor from St. Louis University in 1967 and his Bachelor of Arts from St. John's University in 1964. He was a member of the United States Army from 1967 to 1969.
